Frequently Asked Questions

For attorneys, insurers and injured individuals considering a neuropsychological evaluation.

What is a personal injury neuropsychological evaluation?

An independent evaluation of cognitive, emotional and functional changes after an injury. It compares current functioning with the person's pre-injury baseline and addresses causation, prognosis and treatment needs, for use by courts, attorneys and injured individuals.

How is it different from a neurologist's exam or an MRI?

Neurological exams and imaging look at the structure and medical condition of the brain and nervous system. A neuropsychological evaluation measures how the person actually functions: memory, attention, processing speed, language, executive functioning and mood.

Who can refer?

Plaintiff attorneys, defense counsel, insurers and injured individuals. The methodology is the same regardless of who makes the referral.

Do you provide opinions for legal cases?

Yes. Evaluations are conducted with objectivity and rigor, and reports are written to assist legal decision-making. Dr. Tutty also provides deposition and trial testimony.

What types of injuries are evaluated?

Commonly traumatic brain injury from motor vehicle collisions, medical malpractice, workplace or school incidents and toxin exposure. Wrongful death matters are discussed case by case.

How long does the evaluation take?

Testing is one full day in person. Typically the full evaluation and report take two to three weeks, though timelines are case-dependent and discussed during the consultation.

Is testing in person or by video?

Testing is in person at 353 Lexington Ave, New York. Consultations and feedback sessions can be in person or by video.

How are fees set?

Fees follow a tier system: personal injury evaluations, work product reviews and expert consultation are Tier 2, and expert testimony is Tier 3. A detailed cost sheet shows the fees and initial retainer for each matter.

Will Dr. Tutty treat the injured person afterward?

No. Personal injury services are limited to evaluation and related consultation. The report recommends evidence-based treatment that other providers can deliver.

Do you do custody or divorce evaluations?

No.
